Terms & Conditions 

  1. Thank you for your interest in the Getting Irish Business Online campaign. Google Inc and its affiliates (“Google”) have worked in collaboration with a number of partners, including Blacknight Internet Solutions Ltd (“Blacknight”), An Post, the National Network of County & City Enterprise Boards (the “CCEBs”), to provide Getting Irish Business Online related tools and services posted at www.gettingbusinessonline.ie (the “GIBO Site”). We hope you enjoy using them. These terms and conditions are a contract between you and Google and apply to your use of the GIBO Site. They do not apply to your use of any services offered by Blacknight or any other services provided by partners of Google.
  2. These are the terms and conditions which govern your participation as a user of Getting Irish Business Online. You will be deemed to have accepted them if you use any of the services offered through the GIBO Site.
  3. The key service offered through Getting Irish Business Online is the ability for you, if you are a business to:
    1. set up a website for the use of your business;
    2. associate that website with a website address (“domain name”) for free;
    3. if you opt in as part of the sign-up process, have that website automatically added to Google Places (as a business listing in Google Maps).
  4. In each case, your use of services provided by Blacknight and other partners will be solely governed by the terms and conditions of use of Blacknight and other partners, and are set out here for ease of reference. Google is not responsible for providing these services to you, and you will need to check in each case that you are happy with the service and the terms and conditions of service of Blacknight and other partners before using those services.
  5. Free website creation, domain name and hosting
    1. To create a website through Getting Irish Business Online, you will need to click on ‘create a website now’ and follow the sign up process.
    2. You will receive a free domain name, website and hosting from Blacknight for the period of 12 months.
    3. If you sign up by 9 November 2011, you can choose a .ie, .com or .eu domain name. If you sign up after this date, you can choose either a .com or .eu domain name.
    4. After 12 months, Blacknight will offer you the ability to enter into a further contract for the services (subject to Blacknight continuing to provide the services beyond the initial 12 months and Blacknight’s terms and conditions).
    5. Your agreement with Blacknight for the services they will provide is bound by their terms and conditions and Acceptable Usage Policy which can be found here:   http://www.blacknight.com/acceptable-usage.html 
    6. You may also have the option to use services provided by Google. The use of those services will be governed by Google’s terms and conditions, which can be found here http://www.google.ie/accounts/TOS
    7. You may also have the option to use services provided by other partners. The use of those services will be governed by the partner’s applicable terms and conditions.
  6. Restrictions
    1. You agree not to:
      1. Use the web site creation service or domain name registration service for any purpose other than to promote your business;
      2. Ask for more than one free domain name through the Getting Irish Business Online Site;
      3. Knowingly permit anyone to ask for a second domain name to promote the same business;
      4. Use your free domain name for any other purpose than to promote your business;
      5. Sell your free domain name or the website created through the Getting Irish Business Online service for money or money’s worth, except in the context of selling your business as a going concern.
      6. Use any services provided by Blacknight, Google or any other partner in breach of any of the terms and conditions for the use of those services.
    2. You understand that these terms and conditions may also apply to the services offered by Blacknight and other partners, where they are incorporated into their terms and conditions.
  7. Data protection and privacy
    1. Any data including personal data which:
      1. you enter into a website run by Google (including the GIBO Site) will be held by Google subject to Google’s privacy policy (available here: http://www.google.com/intl/en/privacy/privacy-policy.html) and
      2. you enter into a website run by Blacknight Internet Solutions Ltd (including Blacknight’s Getting Irish Business Online site http://gettingbusinessonline.blacknight.ie and Blacknight’s control panel at http://cp.blacknight.com, will be held by Blacknight subject to Blacknight’s privacy policy (available here: http://www.blacknight.com/privacy.html).
    2. Blacknight and Google may share this data with each other, with An Post, and trusted third parties involved in Getting Irish Business Online in order to provide the services offered under Getting Irish Business Online (including the site you create and the domain name you acquire).
    3. Google, Blacknight, An Post, the CCEBs and other trusted partners may, if you have given your consent in the sign up process, contact you to help you benefit from the service and provide information about other products and services that may be of interest to you.
    4. When you request a free domain name, Blacknight is obliged to provide registrant details to IEDR, a body which administers .ie domains, EURID, a body which administers .eu domains, and Verisign, a body which administers .com domains. IEDR, EURID and Verisign will make those details available through a publicly accessible record called a “WHOIS” record, which you can find here: http://www.IEDR.ie
  8. Changes and third party services
    1. Google, Blacknight, An Post, the CCEBs and other partners of Getting Irish Business Online reserve the right, at their sole discretion, to change, modify, add, or delete portions of these terms at any time without further notice. If this happens, the new terms will be posted on the GIBO Site. Your continued use of the site you have created via Getting Irish Business Online, or the GIBO Site after any such changes constitutes your acceptance of the new terms.
    2. Google, Blacknight, An Post, the CCEBs and other partners of Getting Irish Business Online may change the GIBO Site and the services offered through it from time to time without liability to you. Google does not accept responsibility for or endorse any third party services offered through the GIBO Site.
  9. Withdrawal of services.
    1. If you use the GIBO Site or any of the services offered through the GIBO Site in contravention of these terms, or of any other terms referred to in these terms, or if you use them against the spirit of the Getting Irish Business Online campaign, the services you are being provided may be withdrawn from you.
    2. Google, Blacknight, An Post, the CCEBs and partners may end or suspend Getting Irish Business Online or the GIBO Site at any time at their sole discretion without any liability to you. This will not affect the existence of your site.
  10. Data Sharing.                                                                                                                                                                                                           The Getting Irish Business Online website is a cooperative effort between Google and Blacknight. This website uses Google Analytics, a web analytics service provided by Google.  Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the GIBO Site. The information generated by the cookie about your use of the website (including your IP address) will be t ransmitted to and stored by Google on servers in the United States. Google will use this anonymous user behaviour information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.  Google may also transfer this information to third parties where required to do so by law, to Blacknight or where such third parties process the information on Google's behalf. This means that Blacknight will be able to view anonymous user behaviour on this site. Google will not associate your IP address with any other data held by Google.  You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.  By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
